'eFundraising Solutions Ltd', a company registered in England & Wales under company number 7600950 having its registered office at 89 New Bond Street, London, England, W1S 1DA, owns the rights to the website appearing at the domain ‘www.our-megastore.com/arabtrust’.

You may use ‘www.our-megastore.com/arabtrust’ if you agree to abide by these terms and conditions.

1. Meanings and definitions

'EFS' means eFundraising Solutions Limited, registered in England & Wales under company number 7600950

'Click through' means when a link on our site is activated and which therefore displays the relevant retail merchant site on the user’s machine

‘User’ means a visitor to our site

‘Our Site’ means www.our-megastore.com/arabtrust

'Content' means all text, images, photographs, logos, designs, colours, symbols, links, moving or animated images, or sound which is accessible on the site

'Retail merchant' means the person or company whose goods and / or services are available for sale at an external site linked to from our site

2. Commissions and commission rates

EFS receives commission payments when users make purchases on a retail merchant’s site, having clicked through from Our Site. EFS pays this commission to ArabTRUST. These commissions are paid to EFS via an intermediary and from time to time the obligation to pay the commission may be removed, for example in the event that a purchase is returned, refunded, or if a user is not accepted (e.g. for an insurance application).

EFS makes quarterly commission payments to ArabTRUST, provided the total commission raised in the previous quarter is greater than £50. These payments are equal to the total commission (donation rate) advertised on the site, which are received by EFS. EFS is funded through an additional commission payment which is also received from the retail merchants for every purchase. This funds the ongoing management and maintenance of the site.

If the total commission raised in the previous quarter is less than £50, the balance will continue to accrue in the following quarter, at the end of which the commission will be paid if it has risen above £50.

An indication of the commission payments available for each purchase is represented on the site in the form of ‘Up to % donated’ icons. These icons represent the maximum commission available for a purchase with that retailer. However these commission rates vary depending on the product purchased. Where commission rates vary we make our best efforts to detail the correct commission rate by product, but due to the nature of affiliate commission rates this is not always possible. Where a percentage rate doesn’t include the prefix ‘up to’, that rate applies to all purchases from that retail merchant.

From time to time we will alter the site content and structure and we reserve the right to do this even in the event that such changes reduce the functionality or content of the site.

3. Our relationship and agreement

By clicking through to a retail merchant from our site you acknowledge that we have no obligations to you, other than passing on commission to ArabTRUST. Any purchase you make at the external retail merchant represents a contract between you and the retail merchant, and we accept no liability whatsoever.

EFS have no control over the content of external sites, and links to retail merchants appearing on our site are in no way an endorsement of those retail merchants. We do not accept responsibility for any loss or damage, and cannot intervene in any disputes between you and the retail merchant.

4. Termination

We reserve the right to:

Terminate or suspend Our Site without prior notice in the event of suspected misuse of the site. In the event of the site being suspended, commissions earned and due to ArabTRUST will also be suspended subject to an investigation of the suspected misuse.
Notify any relevant authority of information we possess concerning the suspected fraud, including information relating to a user of a computer that we suspect to be involved in the fraud.

5. Site content

Due to the nature of the content on this site and the use of third party links, errors and omissions can and do occur from time to time. We do not warrant the complete accuracy of the site content, nor do we warrant that in all cases the sites we link to are free of viruses or Trojan horses. We do however take all reasonable precautions to ensure the safety of the site and the sites we link to. Views expressed on the site or external sites are not necessarily those of EFS.

We endeavour to ensure the site is always available and functioning properly however we do not guarantee the continued functioning of the site in perpetuity. We reserve the right to cease maintenance or running of the site without prior notice.

6. Copyright

The content on Our Site is owned by ArabTRUST, EFS or third parties. All company logos, adverts, offers etc are used under licence from those parties. All content is protected by copyright throughout the world subject to the laws of England & Wales. The content will be subject to the following restrictions:

You may not:

• Redistribute or publish any content (including, but not limited to) as part of a blog, newsletter, library, archive or other web or non web based service;
• Store pages on any server or storage device connected to an external network;
• Remove the copyright or trade mark notice from any copies of content made;
• Create a database in electronic or manual form by systematically downloading and storing all or any of the content;
• Modify, reproduce or commercially exploit any of the content.

These Terms and Conditions will be subject to English law.

From time to time we may alter these Terms and Conditions and any subsequent use by you of Our Site will be subject to those altered Terms and Conditions.
